Your use of the Service is governed by our Terms and Conditions, and this Privacy Policy supplements (but does not replace) those terms. Definitions. For purposes of this Privacy Policy: “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked (directly or indirectly) with an individual or household. “Inputs” means the content, files, documents, text, data, or other materials you submit, upload, or otherwise provide to the Service. “Outputs” means responses, analyses, recommendations, or other content generated by the Service, including content derived from Inputs. “De-identified” or “Aggregated” information means information that cannot reasonably be used to infer information about, or otherwise be linked to, a particular individual. 1) What Information We Collect A. Information you provide to us We may collect Personal Information and other information you provide directly, including: Account information: name, email address, password (stored in hashed form), business name, and similar identifiers. Business information and files (Inputs): menus, pricing, costs, vendor details, operating assumptions, documents, text, spreadsheets, and other content you submit or upload. Communications: messages you send to us (e.g., emails, support requests), feedback, and survey responses. Do not upload: Social Security numbers, payment card numbers, bank login credentials, or other highly sensitive personal information. Proprietary and Confidential Information: You control what you submit to the Service. Localyst will handle Inputs in accordance with these Terms and our Privacy Policy. Except as described in these Terms and our Privacy Policy, Localyst will not intentionally disclose your Inputs to unaffiliated third parties. You acknowledge that Localyst may provide Inputs (or portions of Inputs) to service providers to operate, maintain, and improve the Service, and may disclose Inputs as required by law or legal process. Any additional confidentiality obligations must be agreed in a separate written agreement signed by Localyst. No guarantee. You acknowledge that no system can be guaranteed 100% secure, and Localyst does not warrant that Inputs will be free from unauthorized access, disclosure, or alteration. B. Information collected automatically When you use the Service, we may automatically collect: Device and usage data: IP address, device identifiers, browser type, operating system, pages viewed, time spent, clicks, referring URLs, and error logs. Cookies and similar technologies: used for authentication, preferences, analytics, and performance (see “Cookies & Analytics” below). C. Payment information (Stripe) If you purchase a paid plan, payments are processed by Stripe. We do not receive or store your full payment card number. Stripe collects and processes your payment card information. We may receive from Stripe limited information such as: payment status and timestamps, the plan/product purchased and amounts paid, billing contact details you provide (e.g., name/email), and in some cases card brand and last four digits (or other limited payment method identifiers). 2) How We Use Information We use Personal Information and other information for purposes including to: Provide, operate, maintain, and support the Service (including creating accounts, authenticating users, providing features, and generating Outputs). Communicate with you regarding the Service (service announcements, administrative messages, and—where permitted—marketing). Improve and develop the Service (including analytics, research, debugging, testing, and performance monitoring). Train and improve our AI and machine learning models as described in Section 3. Protect the Service and users (fraud prevention, abuse detection, security monitoring, and enforcement of our Terms). Comply with legal obligations and respond to lawful requests. We may also use information for other purposes for which we provide specific notice at the time of collection to the extent required by applicable law. 3) AI, Model Training, and Use of Your Inputs Localyst and affiliated service providers may use Inputs you submit (and Outputs derived from those Inputs) to develop, train, fine-tune, evaluate, and improve our AI and machine learning models and related systems. This may involve creating or using: derived data (e.g., embeddings), model weights, aggregated insights or patterns. Once information is incorporated into model training or system improvements, it may not be practically reversible to remove specific Inputs from those training artifacts. You understand that Inputs may include business information you provide and that training may occur as part of improving the Service. If you do not want your Inputs used in this way, do not use the Service. 4) How We Disclose Information We may disclose Personal Information and other information in the following circumstances: A. Service providers and processors We may share information with vendors and service providers that help us operate the Service, such as: cloud hosting and storage providers, analytics providers, customer support tools, email and communications tools, payment processors (including Stripe), AI and machine learning infrastructure/providers. These providers are permitted to process information on our behalf for the purposes described in this Privacy Policy, and they may be subject to confidentiality and security obligations. B. Legal, safety, and compliance We may disclose information if we believe disclosure is reasonably necessary to: comply with law, regulation, legal process, or governmental request, enforce our Terms and policies, protect the rights, property, and safety of Localyst, our users, or others, investigate and prevent fraud, security issues, or other harmful activity. C. Business transfers If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, dissolution, or sale/transfer of some or all assets, information may be disclosed or transferred as part of that transaction (including during due diligence), subject to reasonable confidentiality protections where appropriate. D. With your direction We may share information when you request or direct us to do so (for example, if you connect third-party integrations). E. De-identified / Aggregated information We may disclose De-identified or Aggregated information for lawful business purposes, including analytics, product improvement, and research. 5) Cookies & Analytics We use cookies and similar technologies to: keep you signed in and maintain session security, remember preferences, understand usage and improve the Service. You can control cookies through your browser settings. If you disable cookies, some parts of the Service may not function properly. We may use analytics tools that collect usage data (including via cookies) to help us understand how users interact with the Service. 6) Your Choices A. Account information You may update certain account information through your account settings (if available). B. Marketing communications You can opt out of marketing emails by using the unsubscribe link in those messages. Even if you opt out, we may still send administrative or service-related communications (e.g., security notices, billing messages). C. Cookies You can manage cookies in your browser settings (see Section 5). 7) Data Retention We retain information for as long as reasonably necessary to: provide and operate the Service, comply with legal obligations, resolve disputes, enforce agreements. Retention periods can vary depending on the type of information and how it is used. As noted in Section 3, if Inputs (or learnings derived from them) are incorporated into model training or system improvements, those learnings may persist in training artifacts even after you stop using the Service. 8) Security We maintain reasonable administrative, technical, and organizational measures designed to protect information. However, no method of transmission or storage is 100% secure, and we do not warrant or guarantee absolute security. 9) Children’s Privacy The Service is not directed to children under 13, and we do not knowingly collect Personal Information from children under 13. By using the Service, you understand that your information may be transferred to jurisdictions that may have different data protection laws than your jurisdiction. 11) U.S. State Privacy Disclosure Depending on where you live, you may have rights regarding your Personal Information, which may include the right to request access, correction, or deletion, or to receive information about our processing. We do not sell Personal Information in the traditional sense. We may share information with service providers to operate the Service as described in this Privacy Policy.
